General conditions of sale

ARTICLE 1: PREAMBLE

 

• The customer declares that they have full legal capacity to commit to these General Terms and Conditions of Sale, i.e. that they are at least 18 years of age and are not under guardianship or trusteeship.

 

• The customer declares that they are booking services for personal and private use, or, where applicable, that they are benefiting privately from a personal booking within a group booking (several individuals, associations, companies, works councils or other).

 

• These General Terms and Conditions of Sale express the entirety of the obligations of the parties.

 

 

ARTICLE 2: DEFINITIONS

 

• ‘Spa guest’: a person receiving thalassotherapy/spa treatments as part of an accommodation, catering and thalassotherapy/spa package or an external treatment programme.

 

• ‘Non-spa guest’: a person accompanying the spa guest who has not booked a thalassotherapy/spa treatment package and is staying in the same room/apartment as the spa guest.

 

• ‘Accommodation, catering and thalassotherapy/spa package’: service including accommodation in one of the Roussillhotel group's establishments, as well as a breakfast, half-board or full-board catering option and one or more thalassotherapy/spa treatments.

 

• Accommodation and catering package: service including accommodation in one of the Roussillhotel group's establishments and a breakfast, half-board or full-board catering package.

 

• Accommodation only: service including only accommodation in one of the Roussillhotel group's establishments, excluding any catering package and/or Thalassotherapy/Spa treatments.

 

• Outpatient treatment: service referring to one or more thalassotherapy/spa treatments without accommodation or meals.

 

• Roussillhotel is the name of the group to which the establishments listed in Appendix 1 belong.

 

• Roussillhotel establishment: refers collectively or separately to the hotel or residence, restaurant, golf course and thalassotherapy or spa centre.

 

• Roussillhotel group websites: refers to the websites www.roussillhotel.com, www.hotels-rh.com and the websites of each hotel in the group listed in Appendix 1.

 

• Travel agent/service provider: reseller with commercial agreements with Roussillhotel and authorised to sell its services.

 

 

ARTICLE 3: CONTENT

 

• These General Terms and Conditions of Sale define the rights and obligations of the Parties in relation to the booking of services offered by the Roussillhotel group

 

• These General Terms and Conditions of Sale may be modified at any time without notice. These modifications will not apply to bookings made previously. Only the General Terms and Conditions of Sale in force at the time of booking are binding on the customer.

 

• The customer acknowledges that they have read and accepted these General Terms and Conditions of Sale.

 

 

ARTICLE 4: SERVICES OFFERED BY ROUSSILLHOTEL

 

• The services offered by Roussillhotel are detailed on the Roussillhotel group's websites

 

• All accommodation, catering and thalassotherapy/ Spa packages include breakfast, half board or full board, either traditional or dietary (only at the Grand Hôtel Les Flamants Roses or the Ile de la Lagune, depending on the option chosen). They do not include drinks, tourist taxes and various additional services that the customer may wish to use during their stay (telephone, laundry, etc.).

 

• Accommodation only (as defined in Article 2) refers to the provision of accommodation only in one of the Roussillhotel group's establishments, excluding any catering and/or Thalassotherapy/Spa services.

 

• The accommodation and catering package (as defined in Article 2) refers to the provision of accommodation in one of the Roussillhotel group's establishments, as well as a catering package including breakfast, half-board or full-board traditional or dietary meals (only at the Grand Hôtel Les Flamants Roses or the Ile de la Lagune, depending on the option chosen).

 

• The non-spa guest rate is only valid for people sharing a room or apartment with a spa guest. All non-spa guests staying in accommodation may access the marine area or spa during the opening hours of each establishment, as stated on the Roussillhotel group's websites. For children, access to the swimming pool is permitted when accompanied by a parent, in accordance with the specific conditions and opening hours of each establishment, as stated on the Roussillhotel group's websites.

 

• The opening hours of the restaurants and the times at which thalassotherapy/spa treatments are provided, as stated on the Roussillhotel group's websites, are specific to each establishment and are subject to change without prior notice.

 

 

ARTICLE 5: CONDITIONS FOR CHILDREN, BABIES AND EXPECTANT MOTHERS

 

• Depending on the establishment, children and teenagers between the ages of 7 and 17, as well as pregnant women, may receive certain Thalassotherapy/Spa treatments upon presentation of a medical certificate and/or parental consent form.

 

 

ARTICLE 6: PRICES

The customer guarantees that they are fully authorised to use the means of payment provided for the payment of their order and that this gives access to sufficient funds to cover all costs resulting from the purchase of their service.

The prices indicated are displayed in euros, including VAT, and are only valid for the dates indicated on the booking confirmation.

Prices include VAT applicable on the day of booking and any change in the applicable VAT rate will be automatically reflected in the prices indicated.

For hotel stays, unless otherwise stated in the description of the stay, the prices displayed do not include the following optional costs and services:

• tourist tax;

• medical fees**;

• pets;

• insurance;

• catering services not included in the chosen package;

• drinks;

• activities not included in the chosen package;

• additional services (laundry, etc.);

• and, in general, all personal expenses not included in the chosen package.

 

For stays in residences, prices include the provision of accommodation, water and electricity consumption, and other services specific to each residence as indicated in the booking confirmation. A deposit will be requested upon arrival as a guarantee of the proper use and cleanliness of the accommodation. It will be returned to you afterwards, after deduction of any additional services consumed on site and/or compensation retained for any damage caused and/or poor cleanliness of the accommodation. We remind you that accommodation intended for a specific number of occupants may not under any circumstances be occupied by a greater number of people.

 

 

ARTICLE 7: BOOKING SERVICES

Bookings can be made by telephone on +33 4 68 51 54 54, by email at ./fr/contact or by post to Service Réservations Roussillhotel, 4, rue Verdi, 66750 Saint-Cyprien. Reservations can also be made with each establishment using the contact details provided on their website (see Appendix 1).

 

 

ARTICLE 8: CONFIRMATION OF THE BOOKING

Following their order, the customer will receive a booking confirmation. Confirmation of the customer's booking by the Roussillhotel establishment is subject to receipt of payment for the services in accordance with the terms and conditions set out in Article 9. The booking confirmation summarises the services ordered and the corresponding prices.

 

 

ARTICLE 9: PAYMENT FOR SERVICES

Unless a special offer requires payment of the full amount of the service at the time of booking, the customer must pay a deposit of 30% of the total amount of the service at the time of booking; the balance is payable:

 

• for a stay in a residence: on the customer's arrival and, for the Horizon Golf Saint-Cyprien Pierre & Vacances Premium Residence: 3 days before the start of the stay;

 

• for a stay in a hotel: before the customer's departure at the end of the stay.

The customer may also choose to pay the full amount for the service at the time of booking.

Customers arriving directly at reception who are not registered in our customer database must pay the full amount of the booking upon arrival.

In the event of early departure, the customer's credit card will be debited for the total amount of the booking when they check out at reception.

 

• For external treatments, payment is made by the customer directly to the thalassotherapy centre/spa concerned.

 

• Reservations for accommodation only (as defined in Article 2 hereof) will only be taken into account after the Roussillhotel establishment concerned has debited the guarantee amount representing 30% of the total amount of the service. The balance shall be paid:

- for a stay in a residence: on the customer's arrival and, for the Horizon Golf Saint-Cyprien Pierre & Vacances Premium Residence: 3 days before the start of the stay at the establishment;

- for a stay in a hotel, on site, at the Roussillhotel establishment chosen at the time of departure.

 

• ‘Early Booking’ / ‘Avant-Première’ rates require prepayment of the full price of the stay at the time of booking. These offers can be modified or cancelled up to 20 days before the customer's arrival (with the exception of those at the Royal Hotel, the Grand Hotel Du Midi and the Hotel La Casa Païral). . After this period, the customer will not be entitled to any refund or modification of their stay in the event of cancellation.

 

• Promotions and discounts cannot be applied retroactively under any circumstances.

 

• Any services not used will not be refunded.

 

• Payment can be made by bank transfer, holiday voucher or credit card (Carte Bleue, Visa, American Express, Master Card/Eurocard) held by the person making the booking. In the event of payment by credit card, the customer acknowledges that they have authorised the corresponding amount to be debited.

 

• In accordance with Article L133-8 of the Monetary and Financial Code, and unless otherwise provided by law, the user of payment services may not revoke a payment order once it has been received by the payer's payment service provider.

 

• As a guarantee, the hotel or residence reserves the right to make a pre-authorisation on your credit card upon arrival. This will be lifted on the day of departure and according to the bank's terms and conditions on your bank card. No debit request will be made.

 

• For security reasons, upon arrival at the hotel, your identity document will be checked against your method of payment. The holder of the identity document presented at reception must be identical to the holder of the payment method (bank card/holiday voucher). We thank you for your understanding.

 

ARTICLE 10: EXTERNAL SERVICE PROVIDERS AND PARTNERS

• Articles 8 and 9 above do not apply in the case of online bookings made through the website of a Travel Agent/Service Provider that has an agreement in force with the Roussillhotel establishment concerned. The applicable booking and payment terms and conditions are those of the said travel website.

 

• In any event, before the start date of the stay or outpatient treatment, the customer must have a voucher from the Travel Agent/Online Service Provider to whom they have paid for the service corresponding to the booking.

 

• We cannot be held liable for information provided by third parties and tourist offices, nor can we be held liable for any work or developments undertaken by municipalities, local authorities or private individuals. Certain shops, restaurants, activities and entertainment may be closed at the beginning and/or end of the season without this resulting in a reduction in the price of the stay or giving rise to compensation from us.

 

ARTICLE 11: MEDICAL EXAMINATIONS AND HEALTH

• Medical examinations** are carried out in accordance with the regulations of each thalassotherapy centre/spa. Consequently, guests are invited to contact the centre where the treatments will be provided in order to find out whether or not a medical examination is available on site, prior to the treatments, in order to obtain a medical certificate.

 

• Only the Grand Hôtel des Flamants Roses and the Hôtel L'Ile de la Lagune offer a thalassotherapy package suitable for pregnant women. However, some treatments are available at other centres (information available from the Roussillhotel centre concerned) and pregnant women are advised to consult their doctor before making any booking to confirm their suitability for the treatments available and for exercising with the equipment provided in the fitness areas. It is the customer's responsibility to specify their pregnancy status when booking.

• The medical examination or medical certificate presented by the guest determines their ability to participate in the booked treatment.

 

• In general, Roussillhotel cannot be held liable in any way for the misuse of sports equipment, the improper execution of the treatment, the inability to carry out the treatment in whole or in part, or to receive treatment due to the customer's state of health, and no refund or claim for compensation may be made on these grounds.

 

• A fitness room is available to customers during their stay. The customer acknowledges that they are aware of the risks involved in using the facilities available to them in the fitness room. Roussillhotel cannot be held liable in the event of damage of any kind resulting from an accident caused by the customer's failure to observe safety rules or the inappropriate use of equipment and/or facilities.

 

• The main therapeutic contraindications for thalassotherapy & spa treatments, sauna and hammam are:

- pregnancy or breastfeeding,

- lack of autonomy,

- surgery less than 3 months ago,

- high blood pressure,

- depression,

 

- recent trauma, fractures,

- endocrine disease: unbalanced dysthyroidism,

- infectious and contagious diseases (fever, tonsillitis, acute infections),

- neurological diseases (unstable epilepsy, multiple sclerosis, Parkinson's disease, etc.),

 

- respiratory diseases (acute or chronic, severe asthma, etc.),

- venous disease: recent phlebitis,

- psychiatric disease: if unstable,

- cardiovascular diseases (heart failure, lower limb arteritis, recent heart attack, acute heart disease, unstable arrhythmia),

- rheumatological diseases (acute rheumatic flare-up, severe osteoporosis, ongoing disc herniation),

 

- cancer in progress or undergoing treatment (chemotherapy, radiotherapy, aplasia), metastases or progressive recurrence of cancer,

- dermatological infection (recent wound or scar that has not closed, oozing, purulent, eczema, psoriasis, unhealed shingles, chronic, varicose ulcer),

- cancer in remission,

- cardiovascular disease (including treated and stabilised),

- high blood pressure,

- kidney disease,

- dermatological disease,

- acute infection.

 

• For a comprehensive list of therapeutic contraindications, the guest is invited to seek any useful information from a doctor of their choice.

 

 

ARTICLE 12: CHANGES MADE BY THE CUSTOMER

• Any change to the dates of the service, the number of people or the services booked, subject to acceptance by the Roussillhotel establishment concerned, will result in an increase or decrease in the initial price. The amount owed by the customer will be that of the modified stay.

• In the event that Roussillhotel is unable to accommodate requests for changes, Roussillhotel cannot be held liable and if the customer wishes to cancel their booking as a result, the cancellation conditions in Article 14 shall apply.

• Any transfer of a stay to a third party is only possible under the provisions of Article L211-11 of the Tourism Code.

 

 

ARTICLE 13: CANCELLATION BY THE CUSTOMER

• The customer is reminded that, in accordance with Article L.221-28 12° of the Consumer Code, they do not have the right of withdrawal provided for in Article L.221-18 of the Consumer Code.

• Any cancellation must be made in writing (by email or post) and will result in:

 

For stays at Relais et Châteaux Ile de la Lagune

Low and Mid Season:

- Cancellation 4 days or more before the date of arrival: full refund of the deposit,

- Cancellation 3 days or less before the date of arrival: retention of the deposit paid at the time of booking and a charge for the total amount of the stay (i.e. 100% of the stay will be charged),

- No-show or interruption during the stay: 100% of the stay will be charged.

 

FROM 21 TO 31 DECEMBER 2025 inclusive and public holiday weekends, FROM 11 JULY TO 22 AUGUST 2026 INCLUSIVE and from 19 to 31 DECEMBER 2026 inclusive:

- Cancellation 8 days or more before the arrival date: full refund of the deposit,

- Cancellation between 7 days and less before the arrival date: the deposit paid at the time of booking will be retained and the total amount of the stay will be charged (i.e. 100% of the stay will be charged),

- No-show or interruption during the stay: 100% of the stay will be charged.

  • 4 days or more before the start date of the service: refund or postponement at no extra cost of the deposit paid at the time of booking.

High season (i.e. from 21 to 31 December 2025 inclusive) and from 11 July to 23 August 2025 inclusive, from 20 December to 31 December 2025 inclusive and public holiday weekends) (From 11 July to 22 August 2026 inclusive) and public holiday weekends:

  • 8 days or more before the start date of the service: refund or postponement at no cost of the deposit paid at the time of booking
  • 7 days or less before the start date of the service: retention of the deposit paid at the time of booking and payment of the total amount of the stay.

- 3 days or more before the start date of the service: refund or postponement at no cost of the deposit paid at the time of booking.

- 2 days or less before the start date of the service: retention of the deposit paid at the time of booking and debiting of the total amount of the stay.

In the event of early departure, the initial amount of the stay will be charged in full.

 

From 4 July to 12 September 2026 inclusive (+ bank holidays and long weekends):

- 7 days or more before the start date of the service: refund or postponement at no extra cost of the deposit paid at the time of booking

- 6 days or less before the start date of the service: retention of the deposit paid at the time of booking and debiting of the total amount of the stay.

In the event of early departure, the initial amount of the stay will be charged in full.

- No-show or interruption during the stay: 100% of the stay will be charged.

 

HIGH AND VERY HIGH SEASON:

- Cancellation 15 days or more before the arrival date: full refund of the deposit,

- Cancellation between 14 days and less before the arrival date: retention of the deposit paid at the time of booking and a charge for the total amount of the stay (i.e. 100% of the stay will be charged).

- No-show or interruption during the stay: 100% of the stay will be charged.

• For any cancellation made 8 days or more before the arrival date: the full deposit will be refunded.

• In the event of a no-show or interruption during the stay: 100% of the stay will be charged.

 

High season (from 11 July to 22 August 2026 inclusive) and bank holiday weekends:

• For any cancellation made 15 days or more before the arrival date: the full deposit will be refunded.

• For any cancellation made 14 days or less before the arrival date: the entire deposit will be retained and the full amount of the stay will be charged.

• In the event of a no-show or interruption during the stay: 100% of the stay will be charged.

In the event of a no-show or interruption during the stay: 100% of the total amount of the stay will be charged.

In the event of multiple bookings: Please note that the Group's general terms and conditions of sale will be applied by the establishment for multiple bookings made in the same name for 3 or more rooms.

Roussillhotel informs its customers of the existence of an insurance contract covering the consequences of cancellation: it is possible, on request and subject to conditions, to take out cancellation insurance by telephone with a Roussillhotel advisor on +33 4 68 51 54 54. The insurance will cover changes or cancellations made by the customer as specified in Articles 13 and 14. The General Terms and Conditions of Sale for the cancellation insurance offered by Roussillhotel are available on request from Roussillhotel advisers. If an insurance policy is taken out, the insurance premium must be paid at the time of booking, together with the deposit.

 

 

ARTICLE 14: CANCELLATION BY ROUSSILLHOTEL

 

• If Roussillhotel is forced to cancel the service paid for by the customer, Roussillhotel will inform the customer and offer them the same services on other dates, subject to the customer's acceptance. If the customer refuses, they may then request a refund of double (without incurring any penalties or fees) the amount paid for this service. The refund will be made, at Roussillhotel's discretion, by credit to the customer's bank account or by bank cheque.

 

• If this cancellation is imposed by circumstances of force majeure, the customer shall not be entitled to any compensation: Force majeure in contractual matters occurs when an event beyond the control of the debtor, which could not reasonably have been foreseen at the time of conclusion of the contract and whose effects cannot be avoided by appropriate measures, prevents the debtor from fulfilling his obligation (Article 1218 of the Civil Code), and in particular in the event of: strikes, insurrection and riots, climatic, geographical or health conditions likely to endanger the customer's life.

 

 

ARTICLE 15: CANCELLATION INSURANCE - INTERRUPTION OF STAY

 

Roussillhotel allows you to benefit from the guarantees of cancellation and interruption of stay insurance taken out with Gritchen Assurance. This optional insurance is payable in full at the time of booking, at the same time as the deposit, and is non-refundable.

 

 

ARTICLE 16: HEALTH AND SAFETY MEASURES - INTERNAL RULES

• Pets: dogs of the 1st and 2nd categories are prohibited in all our establishments. Upon prior declaration at the time of booking, only one animal per room or apartment is accepted in all our establishments, subject to a financial contribution. Pets must be kept on a leash in all common areas; however, they are not permitted in the vicinity of swimming pools and children's play areas. The pet's health record, rabies certificate and tattoo are required. We reserve the right to refuse dangerous or aggressive animals or those causing any disturbance in the establishments. The Les Bulles de Mer hotel in Saint-Cyprien does not accept dogs.

 

• Car parks: vehicle owners remain solely responsible for any items or property left in their vehicle or for any damage to them. Only one vehicle is permitted per room or apartment.

 

• Guests must wear appropriate clothing and footwear in the gym and fitness areas.

 

• Each Roussillhotel establishment has internal rules and regulations that can be consulted on site. Guests undertake to read these rules before the start of their stay or before accessing the thalassotherapy centre/spa, and undertake to comply with them. Appropriate attire is required at all times. Any behaviour or comments contrary to good morals or public order will result in Roussillhotel asking the guest to leave the establishment or the thalassotherapy/spa centre, without any refund if payment has been made, or compensation.

The customer undertakes not to invite any person whose behaviour is likely to cause prejudice to the establishment or the thalassotherapy centre/spa, which reserve the right to intervene if necessary. The customer may not bring in any drinks or food from outside. The general ban on smoking in public places applies in establishments or thalassotherapy/spa centres.

 

 

ARTICLE 17: LIABILITY

 

• The services offered comply with current French legislation. Roussillhotel cannot be held liable in the event of non-compliance with the legislation of a third country.

 

• Roussillhotel cannot be held liable for the non-performance or poor performance of the booking in the event of force majeure, in the event of an act by a third party or an act by the customer.

 

• The photographs, graphic representations and descriptions appearing on the Roussillhotel websites correspond to the room categories mentioned. The layout of the facilities may vary slightly from one room to another, in accordance with the description of the category.

 

• Roussillhotel cannot be held liable for theft or damage to personal belongings inside or outside the rented rooms or apartments, or to vehicles and the contents thereof. Customers are required to take out insurance with an insurance company against the risks inherent in their stay, namely: theft, loss or damage to their personal belongings, as well as for any damage they may cause to the rented room or apartment and also for any damage they may cause to the buildings as a whole, whether through their own actions or through their negligence. Roussillhotel cannot be held responsible for unforeseeable circumstances or force majeure such as climatic disasters or external disturbances that may disrupt, interrupt or prevent the stay. If circumstances require us to do so, in the event of force majeure events beyond our control, we may be obliged to modify our programmes in whole or in part (total or partial closure of a site, shared facilities such as a swimming pool, playground, restaurant, etc.). Force majeure shall in no case give rise to a reduction in the price of the stay or compensation from us.

 

 

ARTICLE 18: RESPECT FOR PRIVACY

 

• The information requested from the customer is necessary for processing their booking and will be stored in the Roussillhotel group's shared database. If this information is not provided, Roussillhotel will not be able to process the booking.

 

• The customer may write to Roussillhotel, whose contact details are provided in the ‘Booking confirmation’ section, to exercise their rights of access, opposition on legitimate grounds or without grounds in the case of prospecting, and rectification with regard to information concerning them and processed by Roussillhotel, under the conditions provided for by the law of 6 January 1978. Roussillhotel declares that it has completed any formalities required by the French Data Protection Authority (Commission nationale de l'Informatique et des Libertés).

 

• The information that the customer provides to Roussillhotel when placing an order is not passed on to any third party. This information is considered confidential by Roussillhotel. It is used solely by Roussillhotel's internal departments for the purpose of processing the customer's order and to enhance and personalise communication and the services offered to Roussillhotel customers.

 

• The customer has the option of expressly consenting to receive direct marketing in the form of e-mails or postal mail. The customer has the option of objecting, by e-mail or by registered letter with acknowledgement of receipt, to the use of their data for marketing purposes, in particular commercial marketing.

 

• In accordance with Article L.223-1 of the French Consumer Code, customers who do not wish to receive commercial prospecting by telephone may register free of charge on a list of objections to telephone canvassing. This list is accessible via the following website: www.bloctel.gouv.fr

 

 

 

ARTICLE 19: INTELLECTUAL PROPERTY

 

• All texts, images and sounds reproduced on the Roussillhotel websites and those of each establishment are protected by intellectual property rights worldwide.

 

• These General Terms and Conditions of Sale do not entail any transfer of intellectual property rights of any kind over elements belonging to Roussillhotel or its beneficiaries, such as photographs, images, literary texts, artistic works, trademarks, graphic charters and logos, to the customer.

 

• Internet users who have a personal website and wish to place a simple link on their site for personal purposes, linking directly to the home page of the www.roussillhotel.com website or to one of the establishment's websites, must obtain the prior and express authorisation of Roussillhotel to establish this link.

 

• In any event, hypertext links to the www.roussillhotel.com website must be removed at Roussillhotel's first request.

 

 

ARTICLE 20: APPLICABLE LAW

 

• The applicable law is French law.

 

• In the event of a dispute, and in the absence of an amicable agreement between the parties, the court with territorial jurisdiction shall have jurisdiction.

 

 

ARTICLE 21: PROCEDURES FOR HANDLING COMPLAINTS BY ROUSSILLHOTEL

• Customers must allow Roussillhotel a reasonable amount of time to investigate the complaint and remedy it, if necessary.
